If you play in mission mode I would think the reason you dont get a choice is because they are one of the two primary races in the game. I don't quite understand what you mean here. Could you be more specific ? I know that when I demand an enemies surrender they do not always just happily accept. Make accepting surrender a choice
Currently (1.0.0.94), when an AI empire surrenders this is accepted automatically. I think it should be a choice as begging for mercy and receiving gifts are choices too.
